Terms of Service

Welcome to LiBu / LiBuPlantDyeing. In these Terms of Service, “LiBu,” “LiBuPlantDyeing,” “we,” “us,” and “our” refer to the operator of this online store, and “you,” “customer,” or “user” refers to anyone who accesses, uses, or purchases through the website.

Our store is powered by Shopify. By accessing, browsing, using, or purchasing from the store, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy, Shipping Policy, and other posted rules. If you do not agree, do not use the store.

If translations are provided, the English version is the reference version to the extent permitted by law, but this does not exclude mandatory rights in a consumer's place of residence.

1. Eligibility and Accounts

By using the store, you confirm that you have reached the age of majority in your place of residence or have permission from a legal guardian.

You must provide true, accurate, complete, current, and authorized names, email addresses, billing and shipping addresses, telephone numbers, payment information, and order details.

You are responsible for protecting account credentials and activities under your account. You may not sell, transfer, or permit misuse of an account without written permission.

If we reasonably believe that a user has provided false information, engaged in fraud, abused our policies, infringed rights, or used the store unlawfully, we may refuse service, restrict access, suspend an account, or cancel affected orders, subject to applicable law.

2. Product Nature

Every product in our store is a made-to-order, custom, handmade home textile item individually produced after order confirmation. Our products are not pre-manufactured ready-stock items.

Default sizes, standard colors, regular fabrics, hanging methods, panel combinations, or other options shown on a product page are regular production options only. Selecting a default option does not make the product non-custom.

Products may use natural fibers such as linen, ramie, and silk blends, together with plant dyeing, hand dyeing, hand tie-dyeing, original printing, and hand sewing. Natural slubs, knots, minor weaving variations, hand marks, dye and batch variations, and reasonable dimensional tolerances are characteristics of natural materials and craftsmanship and are not automatically defects.

We make reasonable efforts to display products accurately, but screens, photography, lighting, material batches, natural fibers, and handmade processes may cause slight differences in color, texture, size, drape, pattern, or appearance.

Subject to applicable law, we may update, correct, change, or discontinue product descriptions, images, prices, options, specifications, or availability.

3. Orders

Placing an order is an offer to purchase the selected products under these Terms and our store policies.

An automatic order confirmation does not always mean final acceptance. We may reject, cancel, or modify an order for payment verification, obvious pricing errors, material shortages, address issues, shipping restrictions, sanctions or compliance risk, suspected fraud, or another reasonable reason.

Before payment, review the product name, size, color, fabric, quantity, panel combination, hanging method, address, contact details, and every custom specification.

After confirmation and entry into material preparation, cutting, dyeing, printing, sewing, finishing, or packaging, an order normally cannot be changed or cancelled. Returns, refunds, exchanges, and product issues are governed by the Return and Refund Policy.

Unless agreed in writing, products are intended for personal, household, decorative, or interior use and may not be purchased for fraudulent activity, unlawful export, or unauthorized commercial resale.

4. Prices, Discounts, Checkout, and Taxes

Product prices, discounts, promotions, shipping charges, and other fees may change. The final product price and shipping charge are those shown at checkout and in the order confirmation, subject to correction of obvious error.

We do not charge or collect sales tax, VAT, GST, or other taxes at checkout. The checkout total consists only of the product price and applicable shipping fee. No tax is separately collected by us.

Cross-border orders may be subject to import duties, import taxes, customs clearance charges, brokerage fees, carrier disbursement fees, or other charges depending on destination, value, classification, materials, origin, and shipping service.

For certain destinations or services, some or all import-related costs may be handled through the shipping arrangement. Charges not covered by the shipping arrangement are payable by the recipient directly to customs, the postal service, a customs broker, or the carrier. See the Shipping Policy for details.

You agree to pay the product price and shipping charges shown in the order and any other amount lawfully payable by you under the shipping arrangement or destination rules. You must not initiate an improper chargeback, payment dispute, or refund claim inconsistent with our policies or applicable law.

5. Payment Information

You represent that payment, billing, and account information is true and accurate and that you are legally authorized to use the selected payment method. We may use third-party payment providers for authorization, risk review, and transaction processing.

6. Shipping and Delivery

Production, processing, shipping, and delivery times are estimates unless expressly guaranteed in writing.

We are not responsible beyond the liability required by applicable law for delays caused by carriers, customs, weather, war, strikes, public holidays, incorrect addresses, failure to cooperate with customs, payment verification, force majeure, or other circumstances beyond our reasonable control.

Customers must provide accurate address and customs information, monitor tracking, cooperate with customs, and pay any charge not covered through the shipping arrangement and properly payable by the recipient.

Original shipping, return shipping, storage, duties, customs clearance, redelivery, or other actual costs caused by refusal, non-collection, incorrect address, clearance failure, or refusal to pay relevant charges may be the customer's responsibility to the extent permitted by law.

7. Returns, Refunds, Exchanges, and Cancellations

These matters are governed by the Return and Refund Policy, which forms part of these Terms.

Because every product is individually made after ordering according to customer selections, to the extent permitted by law we do not accept returns, exchanges, or refunds for change of mind, incorrect size or color selection, personal preference, expectation difference, or no longer needing the item.

This does not affect rights relating to transit damage, verified manufacturing defects, incorrect goods, material difference from the description or confirmed order, or any mandatory consumer right.

8. EU and UK Custom Product Notice

Many distance sales in the European Union and the United Kingdom are generally subject to a 14-day right of withdrawal. However, that right generally does not apply to goods made to the consumer's specifications or clearly personalized.

Every product in our store is produced after confirmation according to the customer's selected size, color, fabric, hanging method, panel combination, pattern direction, or other options and is therefore not subject to the ordinary 14-day change-of-mind withdrawal right.

Statutory rights for defects, transit damage, incorrect goods, or goods not as described remain unaffected.

9. Intellectual Property

Brand names, trademarks, product names, text, product descriptions, photographs, graphics, original patterns, textile designs, videos, page layouts, visual arrangements, logos, icons, and other store content are owned by LiBu, our partners, licensors, or other rights holders and are protected by copyright, trademark, design, and other intellectual property laws.

Without written permission, you may not copy, modify, translate, download, scrape, republish, distribute, display, sell, create derivative works from, or use store content for commercial purposes, machine-learning training, dataset creation, or competitive analysis.

LiBu, LiBuPlantDyeing, LiBu Home, and related brand elements are our commercial identifiers or assets. Shopify and other third-party marks belong to their respective owners.

10. Third-Party Tools, Services, and Links

The store may use third-party payment, shipping, analytics, translation, review, plug-in, or embedded services. Third-party services operate under their own terms and privacy policies. Except where applicable law provides otherwise, we are not responsible for third-party websites, content, availability, security, or transactions.

11. Relationship with Shopify

Shopify provides technical platform services, but products, orders, customer service, returns, and disputes are generally between the customer and LiBu unless law provides otherwise. Shopify does not become the seller merely by providing technical infrastructure.

12. Privacy

Personal information is processed under our Privacy Policy. Shopify and other providers may process necessary information to operate the site, process payments, fulfill orders, prevent fraud, provide support, and meet legal obligations.

13. Reviews, Feedback, and User Content

If you submit reviews, photographs, comments, suggestions, or other content, you represent that you have the rights to do so and that the content is accurate, lawful, and non-infringing. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, display, and distribute the content for business, marketing, support, and product development, subject to applicable law.

14. Errors and Omissions

Store information may occasionally contain typographical, pricing, description, or availability errors. Subject to law, we may correct and update them. If we cancel a paid order because of an obvious error, we will refund the cancelled amount to the original payment method.

15. Prohibited Uses and Automated Access

You may not use the store for unlawful, fraudulent, malicious, infringing, harassing, defamatory, spam, phishing, malware, system interference, unauthorized data collection, security circumvention, or unauthorized commercial scraping or automated access.

Without written permission, you may not use bots, crawlers, scrapers, automated agents, artificial-intelligence tools, or data extraction technologies to access, copy, index, collect, train on, or extract images, product descriptions, patterns, prices, reviews, page structures, blog content, metadata, or other store content. We may use technical restrictions, blocking, investigations, or legal action.

16. Termination

We may suspend or terminate access if we reasonably believe that a user has violated these Terms, abused policies, provided false information, engaged in fraud, harmed others, or used the store unlawfully. Termination does not affect rights, obligations, or liabilities arising before termination.

17. Disclaimer and Limitation of Liability

To the extent permitted by law, the store, services, and content are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, secure, or purpose-specific availability. This does not exclude any warranty, legal guarantee, or consumer right that cannot lawfully be excluded.

To the fullest extent permitted by law, we are not liable for indirect, incidental, punitive, special, or consequential loss. Our total liability relating to a particular product or order will generally not exceed the amount paid for that product or order. This does not exclude liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

18. Severability, Entire Agreement, and Changes

If any provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a right immediately is not a waiver. These Terms and posted policies form the entire agreement regarding use of the store and transactions.

We may update these Terms because of legal, platform, or operational changes. Where required, notice of material changes will be provided. Continued use after the effective date means acceptance, but an update will not retroactively remove an accrued statutory right.

19. Governing Law and Disputes

To the extent permitted by law, these Terms are governed by the law of the jurisdiction in which LiBu is registered or principally established. Mandatory consumer protection, jurisdiction, and remedy rights in the consumer's place of residence remain unaffected.
